In the event that the Company replaces, modifies, or amends this document, your continued use of the Services after a change in the Effective Date of such changes will constitute your acceptance of any replacement, modification, or amendment to this document.

Commercial Representations

By using the Services, you represent that you are at least eighteen (18) years old, are of sound mind, and have the capacity to accept and comply with the terms and conditions contained in this document. If you use the Services on behalf of a business entity or another third party, you represent that you have the actual authority to act as an agent for that business entity or third party and that you have the right and capacity to accept and bind that third party or business entity to the terms of this document on its behalf.

You represent that the use of the Services does not violate any law, regulation, ordinance, statute, or treaty applicable to individuals or business entities located in the jurisdiction where you reside. Additionally, you represent that the terms of any preexisting agreement do not prohibit you from entering into this document.

Limited License

The Company grants you a limited, non-exclusive, non-sublicensable, non-transferable, revocable, and royalty-free license to use the Services for customary and intended purposes. You are expressly prohibited from scraping, framing, hacking, reverse engineering, crawling, or aggregating the Services or the Company’s website, in whole or in part, without the prior written consent of the Company.

You acknowledge and agree that your limited use of the Services does not grant you any license or intellectual property rights over any technology, intellectual property, copyrights, trademarks, or trade secrets of the Company or any third-party contractor of the same. You acknowledge and agree that your use of the Services is limited by the terms of this document, and you expressly agree not to use the Services in any manner not expressly authorized by the terms of this document. The Company reserves all rights not expressly granted through this document. This license is revocable at any time, and any rights not expressly granted in this document are reserved for the Company.

Service and Price Modifications

The prices of our products are subject to change without notice. We reserve the right to modify or discontinue the Service (or any part or content thereof) at any time without notice.

We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuation of the Service.

Education

Dunomik is an educational company that provides education to its users and awards prizes for their performance on demo trading accounts with simulated virtual capital.

Refunds

Once the payment for your evaluation plan is made, refunds will not be processed.

Refunds after Successfully Completing the Evaluation

We do not offer refunds for the challenge fee for our 1-Step program. Traders are rewarded solely for their performance during the funding stage (phase 2).

Transaction Error

Dunomik is not responsible for transaction errors between the user and different cryptocurrency networks.

Guidelines

The Company will display the guidelines associated with the Services on the Company’s website and via email upon becoming a Trader. These guidelines, which may change periodically at the Company’s sole discretion, are fully incorporated into this document. The Company makes absolutely no promises, guarantees, express or implied, regarding any promise of future employment as a Trader, monetary payments, or any other form of compensation or reward for your performance as a Trader.

You acknowledge and agree that the Company’s website, its providers, and licensors expressly reserve all intellectual property rights in all texts.programs, products, processes, technology, content and other materials appearing on the Company’s website. Access to this website does not confer, and shall not be deemed to confer, on anyone any license under any of the intellectual property rights of the Company or any third party. All rights, including copyright, in this website are owned by us or licensed to us by third party providers. Any use of this website or its content, including copying or storing part of it, other than for personal, non-commercial use, is prohibited without the permission of the Company. You may not modify, distribute or republish anything on this website for any purpose.

The Company is not responsible for communication failures or delays when operating over the internet. The Company employs backup systems and contingency plans to minimize the possibility of system failures.

Duration and Terms

The term of this document will begin when you purchase a service offered through the Company and will continue until the Company cancels your access to the Services or you cease to use them.

The Company reserves the right to cancel the Services or your access to the Company’s website at its sole and absolute discretion and without prior notice.

Disclaimer of Warranties and Limitation of Liability

You acknowledge and agree that the Company’s service and website are provided “as is” and without any warranty of any kind, including, but not limited to, warranties of title, merchantability, accuracy, fitness for a particular purpose, security, and non-infringement. To the extent permitted by law, you acknowledge that the Company shall not be liable for any claim, damage, judgment, liability, or fee arising from or related to the information on the website and your use of or access to the Company’s service or website, including, but not limited to, compensatory damages, consequential damages, special damages, incidental damages, punitive damages, exemplary damages, costs, and attorney’s fees, damages resulting from errors or omissions, and damages resulting from website downtime or unavailability.

Force Majeure

The Company shall not be liable to the Trader for any claim, loss, damage, cost, or expense, including attorney’s fees, directly or indirectly caused by any event, action, or omission, including, but not limited to, claims, losses, damages, costs, or expenses resulting from civil disturbances, wars, insurrections, international interventions, government actions (including, but not limited to, exchange controls, confiscations, nationalizations, devaluations), natural disasters, force majeure events, market conditions, inability to communicate with any relevant party, or any delay, interruption, failure, or malfunction of any transmission or communication system or computer facility, whether owned by the Company, the Trader, or an external service provider.

Severability

In the event that any term or condition of this document is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining terms and conditions of this document shall remain in full force and effect.

Interpretation

This document shall be deemed to have been drafted by both parties, and the terms and conditions of this document shall not be construed against the party who drafted it.

Assignment

You are expressly prohibited from assigning your rights and duties under this document. The Company reserves the right to assign its rights and duties under this document, including in the event of a sale of the Company or its Services.

Waiver

No term or condition of this document or breach of this document shall be deemed waived or consented to unless such waiver is in writing and signed by the party to whom the waiver is attributed.

Entire Agreement

This document constitutes the entire agreement between the Company and the Trader regarding the use of the Services and supersedes all prior understandings, agreements, or representations between the Company and the Trader, whether written or oral.

Indemnification

You agree to indemnify, defend, and hold harmless Dunomik and our parent company, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

Severability

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service; such determination shall not affect the validity and enforceability of any other remaining provisions.

Prohibited Uses During the Funded Stage

You are expressly prohibited from using the Services to violate any law, statute, ordinance, regulation, or treaty, whether local, state, provincial, national, or international, or to violate the rights of any third party, including but not limited to intellectual property rights, privacy rights, publicity rights, or other personal or property rights.

Additionally, you are expressly prohibited from scraping, crawling, framing, unauthorized linking, aggregating, hacking, performing denial-of-service (DOS) attacks, reverse engineering, or circumventing technological protection measures of the Services or the Company’s website.

You are also prohibited from using the Services or the Company’s website to transmit unsolicited commercial emails to third parties or the Company’s Traders. While the Company is not responsible for any content posted by its Traders and has no affirmative obligation to monitor such content, it reserves the right to remove it.

Prohibited Trading Strategies During the Funded Stage

You are strictly prohibited from employing any trading strategy related to the following operations:

  • Exploiting errors or latency in prices and/or platforms provided by the Broker.
  • Using non-public and/or insider information.
  • Engaging in “front running” on trades executed elsewhere.
  • Trading in any manner that jeopardizes the relationship the Proprietary Account has with a broker or that may result in the cancellation of trades.
  • Trading in any manner that creates regulatory issues for the broker.
  • Using any third-party strategy: off-the-shelf strategy or one marketed to pass evaluation accounts.
  • Third-party management: copying trades from other traders.
  • Grid Trading: Grid Trading is a prohibited trading strategy due to the potential risks involved. It involves placing opposing buy and sell orders on the same instrument with the same or similar risk, which can lead to market manipulation, over-leveraging, market instability, and the potential to obtain risk-free profits. To avoid significant losses and over-leveraging, it is essential to have a well-defined risk management strategy.
  • Martingale: Dunomik’s Terms of Use prohibit the use of Martingale as a trading strategy. Martingale is based on increasing the investment size after each loss, expecting a winning trade to recover all previous losses and generate a profit. This type of activity is considered a form of gambling and is extremely risky, as it can lead to significant drawdowns and the loss of all capital. It is essential to have a clear risk management strategy and avoid investing all capital in a single trade.
  • Sharing or Selling Accounts: Sharing or selling funded accounts from one person to another is against our Terms of Service and will result in a ban from Dunomik.
  • Collusion Between Users: An individual or group of individuals may engage in a trading strategy known as “account trading.” This involves opening multiple accounts with a financial institution and executing trades in the same direction (i.e., buy or sell) on the same asset across all accounts. This practice is considered a form of market manipulation.
  • Hedging or Group Hedging in Multiple Accounts: An individual or group of individuals may employ a trading strategy where they open multiple accounts with a financial institution and execute trades in opposite directions (i.e., buy and sell) on the same asset across all accounts. In the real market, this would not generate any profit as the positions are hedged in both directions. However, when trading with a Funding Company, one account would generate a loss for the firm, while the other would generate a profit, resulting in risk-free profits.
  • Using Delayed Data: This refers to using a data source that has a delay or lag in delivering market data, such as stock prices or trading volumes. This gives a trader an unfair advantage over other traders who must use real-time market data. This is considered unethical and is not allowed in the real financial market.
  • Trading on Delayed Charts: Trading on charts with a delay or lag in their updates is considered unethical and goes against real market trading.
  • High-Frequency Trading (HFT): High-frequency trading is a trading strategy that uses advanced computer algorithms and high-speed telecommunications networks to execute a large number of trades in a fraction of a second. However, HFT is prohibited as it can lead to market manipulation, create unfair advantages, and cause market instability.

On our platform, we expect all traders to use our services fairly and honestly and to comply with all laws, regulations, and our Terms of Use.

Valid Uses During the Evaluation Stage (Phase 1) That Are Prohibited During the Funded Stage

High-Frequency Trading (HFT), Hedging, Swing Trading, Martingale, and Grid Trading.

Password Changes

Under no circumstances will it be possible to change the password, and we will make no exceptions. The responsibility for the password of each account rests with each client.

Payments

The client will be eligible to receive a payment from the company provided that they have successfully passed the evaluation phase, have traded the funded account in total compliance with the company’s operational rules, and have been approved by the company.
